Terms of Service

These Terms govern your use of NamingStorm (namingstorm.com). By using the app, you agree to them. If you don't agree, don't use the service.

1. What NamingStorm Is

NamingStorm generates candidate business names, phonetic/trademark scoring, and related creative content using AI (Google Gemini) and third-party data sources (domain registries, MarkerAPI). It is a creative ideation tool, not a legal, trademark, or business advisory service.

2. No Guarantee of Results — AI Output Disclaimer

Every name, score, availability check, and trademark screen the app produces is provided "as is," for informational and creative purposes only. We do not guarantee that any name is:

unique, original, or free of prior use anywhere in the world;
available as a domain or trademark at the time you act on it (availability changes constantly and our checks are a snapshot, not a reservation);
registrable, or free from conflict with an existing trademark, business name, or common-law right;
accurate, complete, or error-free — AI-generated content can be wrong, and phonetic/trademark scores are heuristic estimates, not legal opinions.

The in-app trademark screen (when shown) is explicitly a preliminary, automated check — not a clearance search and not legal advice. You are solely responsible for independently verifying any name — including a real trademark clearance search by a licensed attorney — before registering a domain, filing a trademark application, or using a name commercially.

3. Your Account and Acceptable Use

You must provide accurate information and are responsible for activity under your account.
You may use the app as a guest with reduced functionality, or create an account via Google Sign-In.
You agree not to: abuse the service to generate unlawful, infringing, or harmful content; attempt to circumvent usage limits or paywalls; scrape, reverse-engineer, or resell the service; or interfere with its operation.
We may suspend or terminate access for violation of these Terms, at our discretion.

4. Payments

Paid plans (single report packs, Pro subscription) are processed by Stripe. We do not store your card details.
Subscriptions renew automatically until cancelled; you can cancel any time via the billing portal, effective at the end of the current billing period.
Because reports are generated instantly on purchase, all sales are final and non-refundable once a report or credit has been used, except where required by law.

5. Ownership

You own the rights to use names you select, to the extent NamingStorm has any rights to grant — we make no representation that we or you have exclusive rights to any generated name, since names are not the kind of content that can be exclusively "owned" by a generator.
The app itself, its design, code, and the "Unicorn Protocol" methodology are NamingStorm's property.
The product briefs and inputs you submit remain yours; you grant us a license to process them (including sending them to Google's Gemini API and other named third parties) solely to provide the service.

6. Limitation of Liability

To the fullest extent permitted by law: NamingStorm and its operator are not liable for any direct, indirect, incidental, consequential, or special damages arising from your use of, or reliance on, any name, score, availability result, or other content the app provides — including but not limited to trademark disputes, lost domains, rebranding costs, or business losses. Our total liability for any claim relating to the service is capped at the amount you paid us in the 12 months before the claim arose (or $0 if you used the service for free).

7. Indemnification

You agree to indemnify and hold NamingStorm harmless from any claim, loss, or damages (including reasonable legal fees) arising from your use of a generated name — including trademark, copyright, or unfair-competition claims brought by a third party against you for a name you chose to register or use.

8. Third-Party Services

The app relies on Google (Gemini, Firebase), Stripe, MarkerAPI, and public domain registries (RDAP). We aren't responsible for their availability, accuracy, or downtime, and your use of features depending on them is subject to their own terms.

9. Changes

We may update these Terms or the service itself at any time. Continued use after a change means you accept the updated Terms.

10. Governing Law

These Terms are governed by the laws of the jurisdiction in which NamingStorm's operator is based, without regard to conflict-of-law principles.
